• Misrepresentation: Providing fraudulent KYC documents, fake trade references, or misleading "Proof of Funds" (POF).

TRADE DISCLAIMER & CONTRACTUAL SUPREMACY

• Informational Purpose Only: All market insights, pricing indicators and service descriptions on this website are for general information. They do not constitute a binding offer to sell or a solicitation to buy commodities.
• Contract Supremacy: CRITICAL: All physical trade transactions are governed exclusively by a formal, signed Sales & Purchase Agreement (SPA) or Proforma Invoice (PI). In the event of any conflict between this website's terms and a signed SPA, the signed SPA shall prevail.

LIMITATION OF LIABILITY & "AS-IS" PROVISION

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:

• SERVICE AVAILABILITY: WE PROVIDE THIS WEBSITE "AS IS." WE DISCLAIM ALL WARRANTIES REGARDING THE ACCURACY OF MARKET DATA OR UNINTERRUPTED ACCESS.
• INDIRECT LOSS: DAIKOKUTEN GENERAL TRADING LLC SHALL NOT BE LIABLE FOR CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF OPPORTUNITY, OR CARGO DEMURRAGE CHARGES.
• LIABILITY CAP: OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE USE OF THIS WEBSITE SHALL NOT EXCEED AED 5,000 OR THE MINIMAL AMOUNT PERMITTED BY DUBAI COURTS.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Daikokuten General Trading LLC and its officers from any claims, losses, or legal costs arising from your breach of these terms, your violation of international trade laws, or any fraudulent documentation provided to our compliance team.

SEVERABILITY

If any provision of these Terms & Conditions is held by a court of competent jurisdiction or an arbitral tribunal to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed severed from these Terms. The invalidity of one provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

GOVERNING LAW & DISPUTE RESOLUTION

These terms are governed by the Federal Laws of the United Arab Emirates as applied in the Emirate of Dubai.

• Amicable Settlement: The parties agree to attempt to resolve any dispute through good-faith negotiation for a period of thirty (30) days.
• Jurisdiction: If negotiations fail, the dispute shall be subject to the exclusive jurisdiction of the Dubai Courts.

We reserve the right to update these Terms at any time. Your continued interaction with the entity following such updates constitutes your acceptance of the revised Terms.
